XTraxx.com (sometimes referred to as the “Site”) is owned and operated by XTraxx, Inc (the “Company,” “We,” or “Us”). The following privacy statement (the “Policy”) describes the practice of the Company with respect to the collection, maintenance and disclosure of information on the Site including information collected from or provided by each user (“You”). If you do not agree to this Policy, You must cease all use of the Site. In addition, to use this Site, you must agree to the applicable terms of use (the “Terms of Use”) posted on the Site. This Privacy Policy forms part of the Terms of Use.

Personal Information You Submit:
If You access certain features and functions of the Site, the Company collects information that You submit into data fields on the Company’s Site.  For example, You may submit Your name, postal address, email address, and/or other information in order to upload or purchase music, register for the Company services or programs, contact customer service, or respond to surveys.  Personal information (e.g., name and e-mail address) provided by You on this Site is used to provide services You have chosen on the Site and may be used for other purposes described in this document. 

As a necessary part of running the Site and any services You request, We may disclose information collected from You as described in this policy.  For example, We will disclose certain Personal Information about You to Our third-party service providers, such as credit card processing companies, to various taxing or other governmental authorities, as requested by law, [and to the owners of the relevant music (or other rights holders)]. These disclosures (“Necessary Disclosures”) are necessary if You wish to use the Site.  If You do not want Us to make such Necessary Disclosures You must not use the Site.

The Company also uses information collected through the Site to communicate with You in order to provide promotional materials about the Company and/or about our business partners and affiliates.  However, unlike communications which are necessary to provide You with requested services, promotional communications are optional, and the Company will refrain from sending promotional communications to You, if You inform us that You prefer not to receive them. You may request a description of what information the Company has collected from You and submit a request to correct such information from xtsupport<at>xtraxx.com. However, the Company has no control over information once it has been disclosed to third parties as either an optional or Necessary Disclosure.

Passive Collection of Non-identifying Information:
Non-identifying information about You, such as the URL of the website You just visited and the Internet browser version You use when accessing the Site, are automatically transmitted to the Company via your Internet browser.  Passive information collection technologies can make Your use of the Site easier by allowing the Company to provide better service, customize the Site based on consumer preference, compile statistics, analyze trends, and otherwise administer and improve the Site.  Certain features of the Site may not work without use of passive information collection technologies.  Information collected by these technologies cannot be used to identify You.  In addition to the uses described above, the Company uses this non-identifying information about you for marketing purposes. We may share non-identifying information with our partners and other third parties. 
When using the Site, we may create “cookies” on Your computer for purposes of facilitating and maintaining Your current user session, and may collect personal data using those cookies in order to enable us to identify You in connection with the Service and to track use of the Site for purposes consistent with this policy. Security
We have security measures in place to protect against the loss, misuse and alteration of the information under our control, both online and offline.

All Your personal information is restricted in our offices other than as discussed pursuant to this policy.  Only employees or other agents doing work on Our behalf who need the information are granted authorized access to personally identifiable information we control.  All such employees or other agents doing work on Our behalf have signed a non-disclosure agreement prohibiting the unauthorized disclosure, use or distribution of user information.  Furthermore, all employees are kept up-to-date on our security and privacy policies and practices and on the importance of maintaining and working with all user information in a secure and confidential manner. 

Although We have established and maintain commercially reasonable security procedures to protect Your personally identifiable information, "perfect security," does not exist on the Internet.  Furthermore, due to the existing legal regulatory and security environment, We cannot fully ensure that Your private communications and other personally identifiable information will not be disclosed to third parties.  For example, as described above, We may be forced to disclose information to the government or third parties under certain circumstances, or unauthorized parties may unlawfully intercept or access transmissions or private communications.  Additionally, in the unlikely event We need to investigate or resolve possible problems or inquiries, We can (and You authorize us to do so) disclose any information about You to private entities, law enforcement or other government officials as We, in our sole discretion, believe necessary or appropriate. We also can not make any guarantees about the security of our partners and other accepters of Necessary Disclosures and optional disclosures.

Policy Changes
The Company reserves the right to amend this Privacy Policy without prior notice.  If the Company changes its privacy practices, a new Privacy Policy will reflect those changes and the revised Policy will be effective immediately upon posting to this Site.  It is Your responsibility to check this Site from time to time to check for any amendments to the Policy. Your continued access to and/or use of the Site constitutes your assent to, and acceptance of, this policy, including all posted changes.
